Welcome to Neutral Wellness Centre. Please read these Terms and Conditions carefully.
By purchasing a membership, class pass, or attending any class or activity at Neutral Wellness Centre, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, you must not obtain a membership or attend our studio.
1. Definitions
In these Terms and Conditions:
- Neutral Wellness Centre, we, our, or us refers to Neutral Wellness Centre and its representatives including employees, instructors, contractors and affiliates.
- Member means any person who purchases a membership, class pass, or attends classes at Neutral Wellness Centre.
- Studio means any premises operated by Neutral Wellness Centre.
- Classes refers to yoga, pilates, fitness or wellness classes provided by Neutral Wellness Centre.
- Membership refers to any membership, class pass, or introductory offer purchased from Neutral Wellness Centre.
2. Agreement to Terms
By purchasing a membership, class pass or entering the studio, you acknowledge that you have read and agree to these Terms and Conditions.
Neutral Wellness Centre may update these Terms and Conditions at any time. Updated terms will be published on our website or otherwise communicated to members.
3. Health & Safety
Participation in yoga, pilates and fitness activities involves physical exertion and carries an inherent risk of injury.
By attending classes, you acknowledge that:
- You participate voluntarily and at your own risk.
- You are responsible for ensuring you are physically capable of participating.
- You will inform instructors of any injuries, illnesses, pregnancy, or medical conditions prior to participating.
- You should seek medical advice before beginning any exercise program if you are unsure about your ability to participate.
Neutral Wellness Centre instructors are not medical professionals and cannot assess your medical condition.
4. Studio Conduct
All members must behave respectfully towards staff and other members.
Members must:
- Follow instructor guidance during classes
- Wear appropriate exercise attire
- Maintain studio hygiene (including using a towel)
- Arrive before class start time
- Respect studio facilities and equipment
Neutral Wellness Centre reserves the right to refuse entry or remove any person behaving in a disruptive, aggressive, intoxicated or unsafe manner.
5. Class Bookings
- Classes may be booked through our online booking system or mobile app.
- Bookings open up to 14 days in advance.
- Members may book a maximum of two (2) classes per day in advance, subject to availability.
- Additional classes may be attended on the day if space is available.
6. Cancellation & No-Show Policy
To ensure fair access to classes, the following cancellation rules apply.
Standard Classes
- Cancellations must be made at least 4 hours before class.
- Late cancellations may incur a late cancellation fee.
- Failure to attend a booked class without cancelling may result in a no-show fee.
VIP Private Pilates Classes (1:1)
Due to limited capacity, cancellations must be made at least 2 hours before class.
Late cancellations or no-shows may result in:
- Loss of the class credit, and
- Applicable no-show fees.
Members are responsible for cancelling bookings through the online booking system.
7. Waitlists
- If a class is full, members may join the waitlist.
- Members may be added to a class from the waitlist up to one hour before the class start time.
- If added from the waitlist, standard cancellation policies still apply.
- Members should remove themselves from the waitlist if they are no longer able to attend.
8. Membership Payments
Neutral Wellness Centre offers various membership options including:
- Direct debit memberships
- Class packages
- Introductory passes
- Upfront memberships
Some memberships may require a minimum commitment period. Membership fees may be charged weekly, fortnightly or on a 28-day billing cycle depending on the membership selected.
Members must ensure sufficient funds are available in their nominated payment account.
9. Membership Suspension
Memberships may be suspended subject to the following conditions:
- Minimum suspension: 1 week
- Maximum suspension per request: 6 weeks
- Maximum suspension per year: 10 weeks
Suspension requests must be submitted through the designated online form.
10. Membership Cancellation
After the minimum commitment period has been completed, memberships may be cancelled by providing 5 business days written notice via email.
Cancellation requests must be submitted via email to the studio.
11. Refund Policy
Memberships, passes and class packages are generally non-refundable for change of mind.
However, nothing in these Terms excludes or restricts rights available to you under Australian Consumer Law. Refunds or remedies will be provided where required by law.
12. Personal Belongings
Members are responsible for their personal belongings.
Lockers may be provided for convenience; however Neutral Wellness Centre is not responsible for loss, theft or damage to personal property brought into the studio.
13. Liability
To the extent permitted by law:
- Participation in classes and use of the studio facilities is undertaken at your own risk.
- Neutral Wellness Centre will not be liable for injuries, loss or damage arising from participation in classes or use of facilities.
This clause does not exclude liability where such liability cannot legally be excluded under Australian Consumer Law.
14. Privacy
Neutral Wellness Centre collects personal information to manage memberships and bookings.
We use a third-party booking platform (such as Momence) to manage class bookings and memberships. Your information will be handled in accordance with our Privacy Policy.
15. Changes to Classes or Schedule
Neutral Wellness Centre reserves the right to:
- Change class schedules
- Substitute instructors
- Cancel classes
- Adjust studio operating hours
Where possible, reasonable notice will be provided.
16. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Victoria.
